Following up on my discussion of the difference between legal and physical custody, the next natural topic is support. Every final order of divorce should address the custody and support of the children of the marriage. If you share 50/50 physical custody, then support is not an issue because the physical custodian is presumed to provide his/her fair share of support, so there’s no need for an order.
However, if you are not the physical custodian, the Court will review the financial information you file with your divorce and use the guidelines established by the state to set the amount of support you must pay to the custodial parent. There’s not much wiggle room here. The Court considers both parent’s incomes, so the fight is most often about which side is fudging the numbers on their income statements.
Once the Court rules on the actual income, unless there are extraordinary circumstances, it’s just a matter of using the tables, which are readily available here: http://www.alacourt.gov/ChildSupportObligations.aspx. The Court will then enter a support order that closely resembles the amount suggested by the guidelines.
I said all of that to say this: Child support belongs to the children . The money must be paid to the custodial parent, who is presumed to use the money for the children. When the non-custodial parent refuses to pay the amount ordered, the custodial parent has the duty to seek the money for the children. Sometimes, this requires returning to Court and asking the Court to find that parent in contempt.
Your children are entitled to financial support. While their share might be different according to their ability to pay, both parents have an obligation to provide for their children.
